What is the mission of the Supervisory Body (OdV)?

The OdV is responsible for monitoring and verifying compliance with the Commitments undertaken by TIM, now transferred to FiberCop, in order to ensure equal treatment and fair access to the network for alternative operators. Since 2016, with the entry into force of the new Regulation, the OdV’s scope of activity has also included active supervision of all aspects concerning the principle of non-discrimination.

What is the impact of the separation between TIM and FiberCop on the Supervisory Board (OdV)?

Following the transfer of the business unit and the corporate separation between TIM and FiberCop on July 1, 2024, pursuant to AGCOM Resolution No. 114/24/CONS (Article 59, paragraph 4), the obligations previously incumbent on TIM were transferred to the company that controls the primary and secondary network, namely FiberCop. For this reason, the Supervisory Board continues to monitor compliance with the provisions set out in AGCOM Resolution No. 718/08/CONS and subsequent resolution.

How are the members of the OdV appointed?

The Board is composed of five independent members appointed by FiberCop, four of whom are designated by the Communications Authority and one by FiberCop’s Chief Executive Officer, after consulting the Authority. The members of the Board serve a five-year term and must meet the requirements of integrity, independence, and professional competence. They carry out their duties with full independence.

Who can submit a report?

In accordance with its mandate, the Supervisory Board may only handle matters relating to relationships between telecommunications operators and not reports from individual customers. Therefore, the reporting procedure is available exclusively to telecommunications operators.

What can be reported?

Reports submitted by telecommunications operators may concern any anomalies or inadequacies in FiberCop’s implementation of the Commitments, or possible cases where KPI results do not comply with the principles of equal treatment or the quality objectives of network access services, as well as the presumed lack of effective application and enforcement of the non-discrimination obligation.
