The Supervisory Board’s mission

The monitoring and verification of compliance with the Commitments under AGCOM Resolution No. 718/08/CONS and subsequent resolution, transferred to FiberCop to ensure equal treatment for all communications operators.

The Supervisory Board is tasked with minimizing the risk of discriminatory behavior against operators that use the FiberCop network to provide retail services.

In the electronic communications sector, genuine equal treatment in access to fixed networks can only be achieved if it can be credibly ruled out that the network owner grants preferential treatment that could result in discrimination among alternative operators. It is in this context that the Supervisory Board, for Equal Access to the Communications Network, operates, chaired by leading figures at the national level. Established as part of the commitments undertaken by TIM in 2008, it represents a public-private co-supervision system, assigning various monitoring functions to an independent and autonomous body.

The Supervisory Board is responsible for investigating potential violations of the Commitments, either following reports from third parties or on its own initiative, and communicating the results of its inquiries to both the Authority (AGCOM) and the Board of Directors of FiberCop.

Active oversight of the obligations related to the principle of non-discrimination.

With the entry into force of the new Regulation (July 2016), and thanks to several interventions by the Communications Authority in this regard, the scope of action of the Supervisory Board (OdV) has significantly expanded to include active oversight of all aspects concerning the principle of non-discrimination.

The Supervisory Board also plays a technical and advisory role in supporting both the Communications Authority (AGCOM) and FiberCop in the process undertaken by the latter to define, implement, and operationalize the measures ensuring compliance with the non-discrimination obligation, as part of the new and strengthened equal-treatment model.
Furthermore, the Communications Authority (AGCOM) may request technical assistance from the Supervisory Board for specific studies, analyses, tests, and verifications within its area of competence.

The separation of FiberCop from TIM.

Pursuant to AGCOM Resolution No. 114/24/CONS, the mission and duties of the Supervisory Board remain unchanged even after the transfer of the network business unit from TIM to FiberCop, which took effect on July 1, 2024.

As a result, the Commitments previously incumbent on TIM have been transferred to FiberCop.
